Terms of Service

These Terms of Service ("Terms") govern your use of the TrackSticker website, application, and services (collectively, the "Service") provided by Privacy Oasis LLC ("Privacy Oasis," "we," "us," or "our"), doing business as TrackSticker ("TrackSticker").

By accessing or using the Service, whether as an Owner or a Finder, you agree to be bound by these Terms. Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.

1. Definitions

• "Service": The TrackSticker platform, item recovery system, Dashboard, and Scan Page.
• "QR Code": The unique code attached to a physical item.
• "Owner": The individual who registered the QR Code.
• "Finder": The individual who scans a lost item's QR Code.
• "Location Data": Geographical coordinates voluntarily shared by a Finder.

2. The Service

TrackSticker is a privacy-first notification relay system. We connect Owners with Finders without continuous tracking.

2.1. Notification Only: We provide the technology that facilitates notifications between Owners and Finders. We do not guarantee the recovery, condition, or successful return of any item. We are not responsible for the item itself.

2.2. No Continuous Tracking: Location Data is only generated at the moment of scan, with permission. We do not track history or movement trails.

3. Terms for Owners

• Registration: You agree to provide accurate info and keep your account secure.
• Eligibility: You must be at least 18 years old to create an account or make purchases. Minors aged 13–17 may use the Service only under parent or guardian supervision. The Service is not directed to children under 13 (COPPA).
• Responsibility: You are responsible for applying the sticker and maintaining your physical items. Physical sticker orders ship via standard carriers to the address provided at checkout; delivery dates are estimates and not guaranteed. TrackSticker is not liable for carrier delays or incorrect addresses provided at checkout.
• Payments: Fees are clear at purchase. We may suspend service for non-payment.
• Account Lifecycle: Accounts without an active package and three (3) consecutive years (1,095 days) of continuous inactivity (no owner logins) are considered abandoned and may be closed and permanently deleted. Logging in at any time resets this clock.
• Account termination: We may suspend or terminate accounts that violate these Terms or are used for unlawful, abusive, or fraudulent purposes.

4. SMS Communications & Alerts Disclosure

By opting in to SMS alerts, users agree to receive automated transactional text messages from TrackSticker regarding item scan alerts, finder messages, and account updates. Message frequency varies based on user account activity and item scans. Message and data rates may apply. Consent is not a condition of purchase. Mobile information and consent will not be shared, sold, or rented to third parties or affiliates for marketing purposes.

5. Terms for Finders

• Voluntary: Scanning is a voluntary act of goodwill.
• Consent: TrackSticker does not continuously track Finders. By submitting a scan with location, you consent to sharing that specific coordinate with the Owner.
• Interactions: TrackSticker helps Owners and Finders communicate about lost items. We do not verify identities, ownership, or information, arrange or supervise meetings, or guarantee that an item will be returned. You are responsible for your own interactions and decisions. TrackSticker is not responsible for the conduct of other users.

6. Prohibited Conduct & Acceptable Use

You are responsible for messages and content you submit through TrackSticker. You agree not to engage in any of the following prohibited activities:

• Stalking & Harassment
• Uploading Malicious Content
• Impersonation
• Attempting to Reverse Engineer the Service
• Interfering with the Platform

7. Intellectual Property

All software, design elements, logos, trademarks, QR code format technology, and written content on TrackSticker are the exclusive property of Privacy Oasis LLC. Using the Service grants you no ownership rights to our intellectual property.

8. Disclaimers and Liability

8.1. No Warranties: Service is "AS IS" without warranties of any kind.

8.2. Limitation of Liability: TrackSticker is not liable for indirect, incidental, or consequential damages resulting from the use or inability to use the Service.

8.3. Maximum Liability: Total liability is limited to the amount paid in the last 12 months or $100 USD. These limitations apply to the maximum extent permitted by law, regardless of the legal theory involved. Nothing in these Terms limits liability that cannot legally be limited.

8.4. Indemnification: You agree to defend and indemnify Privacy Oasis LLC and TrackSticker, including their owners, employees, and service providers, against claims, damages, losses, and reasonable legal expenses arising from your misuse of the Service, violation of these Terms, unlawful conduct, or violation of another person's rights.

9. Force Majeure

TrackSticker is not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, telecommunications outages, server failures, cyberattacks, or utility disruptions.

10. Amendments & Updates

We may update these Terms from time to time. We will indicate changes by updating the "Last Updated" date at the top of this page. Continued use of the Service after changes are posted constitutes your agreement to the modified Terms.

11. Governing Law

These Terms shall be governed by the laws of the State of Utah. If you have an issue, Contact Us 30 days before initiating small claims or arbitration actions.
